    What Are CC&R’s?

    Are you planning on buying a home or condo that’s part of a community or new home development in Southern California?

    That community will most likely have a Homeowners Association with Covenant’s, Codes and Restrictions (CC&R’s).

    Covenant Codes and Restrictions (CC&R) are commonplace in homeowner’s associations in SoCal because they are the rules and regulations the homeowner’s association has created for anything related to that community.

    The goal of CC&R’s is to protect, preserve, and enhance the property values for the community where the property is located.

    All About CC&R’s

    Most homeowner’s associations have very detailed CC&R’s for just about every conceivable thing including:

    • Parking restrictions.
    • What you can do to the exterior of the home.
    • Common areas.
    • Pools.
    • Anything related to costs.

    These days it’s not uncommon for a condo complex in Southern California, or a new home community that has single family tract homes, to have a homeowner’s association.

    You can always expect those CC&R’s to be very detailed orientated.

    What Happens If You Violate A CC&R?

    Sadly, some people may violate the CC&R’s for their community either on purpose or by mistake.

    Violating CC&R’s is not a smart thing to do because an HOA will take action against a homeowner if they are found to be in violation of the CC&R.

    Some of the penalties that HOA’s will take against homeowners who violate CC&R’s include: fines, forcing the homeowner to comply with the CC&R, filing a lawsuit against them, or placing a lien on the home if they’ve fallen behind on paying fines or assessments.

    Your Rights as a Home Buyer

    The good news is that you have rights as a homebuyer in Southern California because it’s your legal right to read the CC&R’s for the community before buying a home there.

    When reading CC&R’s you should also pay close attention to Parking Regulations because many HOA’s across SoCal do not allow parking on private streets within the community and they have every right to tow vehicles.

    As a home buyer, you want to know exactly what you’re getting into regardless if you’re going to buy a condo or single-family home that’s part of an HOA.
